Terms of personal data protection Personal data processing policy The physical entepreneuer Tereza Pechova , with its registered office at Skolska 689/20, 110 00 - Prague 1, ID : 04568559, registered in the commercial register kept at the Municipal Court in Prague, ("the Company"), protects all processed personal data as strictly confidential and treats by them in accordance with applicable legal regulations in the field of personal data protection. The security of your personal data is a priority for the Company. In the sense of the General Data Protection Regulation (Regulation (EU) 2016/679), the company is the administrator of your personal data, i.e. it collects, stores and uses (and otherwise processes) your personal data for the performance of its business activities (individual purposes for which they are personal data processed, are defined in more detail below), which consists in the provision of services in the sale of services and products. The provision of the mentioned services takes place mainly through the web portal www.gumiex.com ("Web Portal"). This Personal Data Processing Policy applies to (i) the processing of personal data carried out by the Company during your use of the Web Portal, (ii) the processing of personal data by the Company communicated by you during a telephone conversation with a representative of the Company, (iii) the processing of personal data by the Company during the performance of contracts with customers (Web Portal users) and suppliers, (v) processing of personal data in the fulfillment of the Company's legal obligations and (vi) processing of personal data that is necessary for the purposes of protecting the legitimate interests of the Company. Providing personal data to Financial Institutions is completely voluntary. The automated processing of personal data takes place mainly for the purposes of fulfilling the contractual relationship and offering services and products. The Company is entitled to collect, store and use certain information through automated means, such as statistical information whenever you visit the Web Portal. PROCESSING OF PERSONAL DATA BASED ON CONSENT If you give the Company consent to the processing of personal data for the purpose of sending personalized marketing messages (in these cases, profiling may also occur) or for the purpose of contacting the Company's suppliers with offers of services and products, via e-mail and telephone contact, you acknowledge that that the provision of this consent is voluntary and that the consent can be revoked at any time in writing to the Company's address or via the link provided in the e-mail message with the commercial communication. Consent is granted until revoked. Failure to provide consent does not affect the performance of the contract. RECIPIENTS OF PERSONAL DATA The Company makes your personal data available only to authorized employees or individual processors of personal data contractually agreed by the Company, or to other administrators. However, always only to the extent necessary for the fulfillment of the individual processing purposes, and on the basis of the corresponding legal title for the processing of personal data. The list of recipients of the Company's personal data is available upon request. Often the recipients of personal data will be suppliers of IT services, including cloud storage, marketing agencies, lawyers, suppliers of other services, sales representatives, providers of printing and postal services, or couriers. The company is authorized in cases specified by law, or obliged to transfer some personal data on the basis of valid legal regulations, for example to law enforcement authorities or other public authorities. PERSONAL DATA OF THIRD PARTIES. Personal data of third parties, which means personal data of employees and customers of the Company's suppliers and other natural persons participating in cooperation with the Company, or other data that the Company receives from the supplier in connection with the conclusion or performance of the contract will be processed in accordance with applicable legal regulations in the field of personal data protection. These personal data will be used by the Company for the purpose of fulfilling contracts with suppliers. The company will process personal data of third parties for the duration of the contractual relationship and further for the period determined by special legal regulations, if any. They will then be kept for a longer period if there is a justified need to store data in connection with a specific case. PERSONAL DATA RETENTION PERIOD. PERSONAL DATA RETENTION PERIOD We process and store your personal data for the period necessary to ensure all rights and obligations arising from the relevant contractual relationship and also for the period during which the Company, as the controller of personal data, is obliged to store personal data according to generally binding legal regulations, or for which you have requested the Company to consented to the processing. In other cases, the processing time results from the purpose of the processing, for which it must be adequate, or is determined by legal regulations in the field of personal data protection. This is the right (i) to access personal data, (ii) to correct inaccurate or false personal data, (iii) to delete personal data, if the personal data are no longer needed for the purposes for which they were collected or otherwise processed, or if it is found that they have been processed unlawfully, (iv) to limit the processing of personal data, (v) to the portability of data and (vi) the right to raise an objection, after which the processing of your personal data will be terminated, if it is not proven that there are serious legitimate reasons for processing that outweigh the interests or rights and freedoms of the data subject, especially if the reason is the possible enforcement of legal claims. At the same time, you have the option of contacting the Office for the Protection of Personal Data, with whom you can file a possible complaint. Right to access personal data: if you want to know if the Company is processing personal data about you, you have the right to obtain information about whether your personal data is being processed and, if so, you also have the right to access your personal data. The right to correct inaccurate or false personal data: if you believe that the Company is processing inaccurate or false personal data about you, you have the right to request their correction. The company will carry out the repair without undue delay, taking into account the technical possibilities. Right to deletion: if you request deletion, the Company will delete your personal data if (i) they are no longer needed for the purposes for which they were collected or otherwise processed, (ii) you withdraw your consent to the processing of personal data and there is no other reason for processing, (iii) you object to the processing and there are no overriding legitimate reasons for the processing, (iv) the processing is unlawful, or (v) they must be deleted to comply with a legal obligation. The right to limit the processing of personal data: in the event that you are not interested in erasure, but only in the temporary restriction of the processing of your personal data, you can request the Company to limit the processing of your personal data. The right to data portability: if you want the Company to transfer your personal data, which it processes on the basis of your consent or on the basis of a contract, to a third party, you can use your right to data portability. If the exercise of this right could adversely affect the rights and freedoms of third parties, the Company will not be able to comply with your request. The right to object: you have the right to object to the processing of personal data that is processed for the purpose of protecting the legitimate interests of the Company. In the event that the Company does not prove that there is a serious legitimate reason for the processing that outweighs your interests or rights and freedoms, it will terminate the processing based on your objection without undue delay. If the main essence of your objection is directed against the sending of commercial communications, please use the link at the end of the last commercial communication (newsletter) you received from us to unsubscribe from receiving commercial communications and the processing of personal data for this purpose. In the case of repeated or clearly unfounded requests to exercise the above-mentioned rights, we will be entitled to charge a reasonable fee for the realization of the given right, or we will refuse to realize it.
